TURTLE RELEASE (AGES 13+)

All cancellations require an accommodation fee of 15% of the paid amount.
Cancellations made 30 days before the tour will result in a 75% refund.
Cancellations made 5 days before the tour will result in a 50% refund.

No shows, 24 hours cancellation and same day cancellation, will not receive a refund of any kind and the tickets cannot be used for a different date.

By Purchasing my ticket, I agree that In return for being permitted to participate in the following activity or program (“The Activity”), including any associated use of the premises, facilities, staff, equipment, transportation, and services of “Turtle Tours Mazatlan”, I, for myself and all members in my party, heirs, personal representatives, and assigns, do hereby release, waive, discharge, and promise not to sue The Regents of “Turtle Tours Mazatlan”, its directors, officers, employees, and agents (“The Service Provider”), from liability from any and all claims, including the negligence of The Service Provider, resulting in personal injury (including death), accidents, or illnesses,and property loss, traffic accidents, in connection with my participation in the Activity and any use of The Service Provider’s premises and facilities.

 

Assumption of Risks: Participation in the activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injury or illness, including contraction of COVID-19, the disease caused by SARS-CoV-2 (including any variants). The specific risks associated with any activity will vary, and may include 1) minor injuries such as scratches, bruises, and sprains, to 2) major injuries such as eye injury, joint or bone injuries, heart attacks, and concussions, cutaneous infections, to 3) catastrophic injuries such as paralysis and death, and 4) contraction of COVID-19 which can cause serious illness or death to the participant and others.

 

Indemnification and Hold Harmless: I also agree to indemnify and hold The Service Provider harmless from any and all claims,actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees, arising out of my involvement in The Activity, and to reimburse it for any such expenses incurred.

 

Severability: I further agree that this Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid the remaining portions will continue to have full legal force and effect.

 

Age Restriction: all participants must be at least 12 years of age.

 

Tour Guide Discretion: The tour guide(s) reserve the right to refuse any services (partial or total) if the participants appear to not have the physical and/or mental ability to perform the activity. The physical/mental abilities requirements include but are not limited to: being able to walk on the sand, get on a boat safely, being able to ride a bicycle, etc. Physical/mental limitations include but are not limited to requiring a wheelchair, having had a major surgery recently, being under the influence of drugs, alcohol or other substances.
